    IMPORTANT NOTICE:

By contacting, booking, or using any service from David's Tire and Battery ("DTB"), you automatically agree to all terms listed on this page. If you do not agree, do not use our services.

    1. Independent Contractor Status

All technicians dispatched through DTB are independent 1099 contractors, not employees, agents, or representatives of DTB.

    • DTB functions strictly as a dispatch and coordination service connecting customers with independent service providers.
    • Each contractor is solely responsible for their own actions, tools, insurance, and compliance with all applicable laws and regulations.

    2. Limitation of Liability

By using DTB services, you acknowledge and agree that:

    • DTB is not responsible for damages to vehicles, property, or for personal injury that may occur during or after services.
    • All liability rests with the independent contractor performing the work.
    • Any disputes, damages, or claims must be resolved directly with the contractor.

    3. Customer Responsibility

    You agree to:

    • Provide complete and accurate details about your vehicle and service needs.
    • Inspect the work performed and immediately raise any concerns directly with the contractor.
    • Address any service-related disputes with the contractor directly.

    4. Contractor Responsibility

    All independent contractors agree to:

    • Maintain required licenses, insurance, and certifications to legally perform roadside and tire services.
    • Conduct services in a professional, safe, and lawful manner.
    • Accept full responsibility for their work, including damages or injuries caused during service.

    5. No Warranty or Guarantee

DTB does not offer any warranty or guarantee on work performed by independent contractors. Any warranties, if offered, are solely between you and the contractor.

    6. Indemnification

You agree to indemnify and hold harmless DTB, its owners, and affiliates from any claims, losses, or expenses (including attorney fees) arising from services provided by independent contractors.

    7. Payment

Payments collected by DTB are processed on behalf of the independent contractor. Payment does not create an employment, partnership, or agency relationship between the contractor and DTB.

    8. Changes to Terms

DTB reserves the right to update these Terms of Service at any time. Continued use of our services or website constitutes acceptance of any changes.
